1. Scope
#

These Terms of Participation (“Terms”) apply to the purchase of tickets and attendance at GodotFest, organised by GameDev Events Munich UG (haftungsbeschränkt) (“we”, “us”, “the Organiser”). By purchasing a ticket, you accept these Terms.

2. Tickets & Purchase
#

2.1. Tickets are sold online via our ticketing platform (Pretix). Prices are inclusive of statutory VAT (currently 19%).

2.2. No right of withdrawal. As GodotFest is a leisure event on a fixed date, the statutory right of withdrawal does not apply pursuant to §312g(2) Nr. 9 BGB.

2.3. Tickets are personal. Transfer to another person is possible by contacting us at [email protected] at least 14 days before the event.

2.4. We reserve the right to cancel or reschedule the event due to force majeure or circumstances beyond our control. In the event of cancellation by the Organiser, tickets will be refunded in full. In the event of rescheduling, tickets remain valid for the new date; refunds are available upon request.

2.5. No refunds are issued for voluntary non-attendance.

3. Event Rules

3.1. Attendees must follow the instructions of event staff and venue security at all times.

3.2. We reserve the right to refuse entry or remove attendees who violate these Terms, the event’s Code of Conduct, or applicable laws. No refund is given in such cases.

3.3. GodotFest is committed to being an inclusive and respectful environment. Our Code of Conduct forms part of these Terms.

4. Photography & Video
#

4.1. Professional photography and videography take place throughout the event. This includes event documentation, crowd shots, stage recordings, and interviews. These images and videos will be used for reporting on the event, marketing of future events, social media, and our website.

4.2. Crowd and event-overview images (where no single individual is the main subject) may be published without individual consent. This is based on our legitimate interest in documenting and promoting the event (GDPR Art. 6(1)(f)) and the event-reporting exception under §23(1) Nr. 3 KUG.

4.3. Portrait-style photos or videos (where you are clearly the main subject, e.g. in an interview or speaker spotlight) will only be published with your consent, which we will seek at the time of recording.

4.4. If you do not wish to appear in event photography, you may inform our staff on-site or contact us at [email protected] at any time to request removal of specific images.

5. Data Protection
#

5.1. We process your personal data in accordance with the EU General Data Protection Regulation (GDPR) and German data protection law. Full details are provided in our Privacy Policy .

5.2. When you purchase a ticket, we collect and process the data necessary to fulfil your order (name, email, payment data). The legal basis is GDPR Art. 6(1)(b) (contract performance).

5.3. Data sharing for ticket perks. Certain ticket types (e.g. VIP) include perks provided by third parties (e.g. a dinner at an external venue). To deliver these perks, we share the minimum necessary data (typically your name) with the relevant service provider. The legal basis is GDPR Art. 6(1)(b) (performance of the contract you purchased).

5.4. Sponsor data sharing. We will never share your personal data with sponsors or other commercial third parties without your explicit, separate consent. If applicable, this consent is requested as an optional checkbox during the ticket purchase process and can be withdrawn at any time.

5.5. You have the right to access, rectify, delete, restrict, and port your personal data, and to object to processing. You also have the right to lodge a complaint with the Bavarian Data Protection Authority (BayLDA). Contact us at [email protected] for any data protection requests.

6. Liability
#

6.1. We are liable without limitation for damages caused by intent or gross negligence, and for injury to life, body, or health.

6.2. For slight negligence in the breach of essential contractual obligations (Kardinalpflichten), our liability is limited to foreseeable, contract-typical damages.

6.3. We are not liable for loss of, or damage to, personal belongings brought to the event, unless caused by our intent or gross negligence.

6.4. The above limitations do not affect mandatory statutory liability (e.g. under the Product Liability Act).

7. Final Provisions
#

7.1. These Terms are governed by the laws of the Federal Republic of Germany.

7.2. The place of jurisdiction (Gerichtsstand) is Munich, Germany, to the extent permitted by law.

7.3. If any provision of these Terms is or becomes invalid, the remaining provisions shall remain in effect.

7.4. The Organiser reserves the right to amend these Terms. Amendments to already purchased tickets will be communicated by email.
